1. Agreement to Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Mushroom Computing Ltd ("we", "us", "our") regarding your use of the Malvern View Transport booking system (the "Service").

By registering for and using this Service, you confirm that:

• You have read, understood, and agree to be bound by these Terms
• You are at least 18 years of age
• You have the legal capacity to enter into this agreement
• All information you provide is accurate and complete

2. Nature of the Service

2.1 Community Car-Sharing Platform

The Malvern View Transport Service is a voluntary, informal, non-profit community car-sharing platform designed to facilitate transport arrangements between residents of Malvern View Caravan Park. It is provided as a courtesy to the community at no charge.

2.2 Not a Commercial Transport Service

This Service is NOT:

• A licensed taxi or private hire service
• A professional transport service
• A ride-sharing service operated for profit
• Subject to transport service regulations

All journeys are arranged on a voluntary, goodwill basis between residents helping fellow residents.

3. Limitation of Liability and Disclaimers

3.1 No Liability for Accidents or Incidents

Mushroom Computing Ltd accepts absolutely no responsibility or liability whatsoever for:

• Any accidents, collisions, or road traffic incidents
• Any personal injuries, death, or harm to health
• Any property damage or loss
• Any delays, cancellations, or failure to provide transport
• Any acts, omissions, negligence, or misconduct of drivers or passengers
• Any losses, damages, costs, or expenses arising from use of this Service

3.2 Use at Your Own Risk

YOU USE THIS SERVICE ENTIRELY AT YOUR OWN RISK. All participants, whether drivers or passengers, acknowledge that:

• They participate voluntarily and accept all associated risks
• Mushroom Computing Ltd provides only the online booking platform
• We do not verify, vet, or check drivers' licenses, insurance, or driving records
• We do not inspect or certify vehicles for safety or roadworthiness
• We do not supervise, control, or monitor journeys
• We make no warranties regarding the safety, reliability, or suitability of any driver or vehicle

3.3 Platform Provider Only

Mushroom Computing Ltd acts solely as a technology platform provider. We:

• Facilitate connections between residents
• Provide booking and notification tools
• Do not arrange, provide, or operate transport services
• Are not a party to any transport arrangements made between users
• Have no control over the conduct of users or the condition of vehicles

4. Insurance Requirements

4.1 Driver Responsibilities

If you offer transport as a driver, you acknowledge and agree that:

• You must hold a valid UK driving license for the vehicle category
• You must have appropriate motor insurance that covers voluntary car-sharing or social, domestic and pleasure use
• You must ensure your insurance policy permits carrying passengers on a voluntary basis
• YOU ARE PERSONALLY RESPONSIBLE for ensuring your insurance is valid and adequate
• You must ensure your vehicle is roadworthy, has valid MOT (if required), and road tax
• You comply with all road traffic laws and regulations

4.2 Passenger Responsibilities

If you request transport as a passenger, you acknowledge and agree that:

• You are responsible for verifying the driver has appropriate insurance
• You are responsible for your own personal safety decisions
• You may wish to obtain personal accident insurance
• You accept the driver and vehicle offered entirely at your own discretion and risk

4.3 No Insurance Verification

IMPORTANT: Mushroom Computing Ltd does not verify, check, or confirm that drivers have appropriate insurance coverage. This is entirely the responsibility of drivers and passengers.

5. User Responsibilities

5.1 General Obligations

All users must:

• Provide accurate and truthful information
• Behave courteously and respectfully towards other users
• Comply with all applicable laws and regulations
• Not use the Service for any unlawful or fraudulent purposes
• Not share your account credentials with others
• Notify us immediately of any unauthorized use of your account

5.2 Prohibited Uses

You must NOT:

• Use the Service for commercial transport or for profit
• Charge passengers for journeys (except reasonable fuel contributions agreed between users)
• Use the Service if you are not a resident of Malvern View Caravan Park
• Provide false, misleading, or inaccurate information
• Harass, abuse, or threaten other users
• Attempt to circumvent any security measures

6. Indemnification

You agree to indemnify, defend, and hold harmless Mushroom Computing Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your provision or use of transport through the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any accidents, incidents, or losses occurring during journeys

7. Service Availability and Modifications

7.1 No Guarantee of Availability

We do not guarantee that:

• The Service will be available at all times or without interruption
• The Service will be error-free or secure
• Any drivers will be available to accept journey requests
• Confirmed journeys will not be cancelled

7.2 Right to Modify or Discontinue

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time without notice
• Change these Terms at any time by posting updated Terms
• Refuse service to anyone for any reason
• Suspend or terminate user accounts for violation of these Terms

8. Account Approval and Termination

8.1 Account Approval

Account registration is subject to approval by the Site Administrator. We reserve the right to:

• Decline any registration without providing reasons
• Request additional verification information
• Limit access to residents of Malvern View Caravan Park

8.2 Account Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Provide false or misleading information
• Engage in conduct we deem inappropriate or harmful
• Cease to be a resident of Malvern View Caravan Park

9. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this Service, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.

10. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the property of Mushroom Computing Ltd and are protected by copyright, trademark, and other intellectual property laws.

11. Dispute Resolution

11.1 Between Users

Any disputes arising between drivers and passengers are solely between those individuals. Mushroom Computing Ltd is not involved in resolving any such disputes and accepts no responsibility for facilitating resolution.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mushroom Computing Ltd regarding the Service and supersede all prior agreements and understandings.
